As most Connecticut residents probably know by now, actress Katie Holmes surprised the American public by choosing to file for divorce from Tom Cruise earlier this month. However, Cruise is hitting back with a legal maneuver of his own. In this high-asset divorce, he has filed paperwork in Los Angeles, contending that the family spends most of their time in the California city.
Experts have speculated that Holmes filed for divorce in the state of New York because she stood a better chance of gaining sole custody of the couple's daughter Suri. Cruise is reportedly seeking a more compromise-based joint custody agreement. He is also planning to file a legal response in New York, where he contends the divorce papers were filed under false pretense. Cruise's attorneys plan to argue that Holmes did not live continuously in New York, as required under state law to pursue divorce.
Attorneys for both sides agree that this is likely to be a highly public and contentious custody battle, considering that Holmes appears unwavering in her quest for sole custody of Suri. Cruise's legal team says he will refuse to surrender sole custody of his child to Holmes, largely because she cannot prove that he is a 'deadbeat dad.' Holmes has said that she fears for Suri's physical health if Cruise retains joint custody.
The couple had wed in 2006 and appeared to be happily married until the recent sudden turn of events. Holmes had reportedly wanted to end the marriage for months, even though 49-year-old Cruise advertised that their partnership was stronger than ever. Holmes said she has felt suffocated under Cruise's devotion to the controversial religious traditions of Scientology, which eschews many medical treatments, including therapy for psychiatric and psychological conditions.
Cruise has two other children with ex-wife Nicole Kidman. It is not clear whether Cruise shares joint custody of the 17-year-old, but one of his children from that marriage recently turned 18.
