Republican ads woo disillusioned Obama voters

NEW YORK (AP) ? One Republican campaign ad describes the "buyer's remorse" some voters feel about President Barack Obama. Another ad features a woman saying she had supported Obama because "he spoke so beautifully" but he's failed to deliver on his promises.

Still another ad woos Obama supporters with a direct but gentle prod: "It's OK to make a change."

Republicans are trying to persuade voters who supported Obama in 2008, many of them women, to switch to Republican candidate Mitt Romney.

To reach them, Republicans have adopted a political soft sell: Coax them without criticizing the choice they made four years ago.

That strategy draws a rebuke from Obama campaign spokeswoman Jen Psaki (SAH'-kee). She says Romney's positions on issues important to millions of women across the country are out of whack.

Toshiba slips into the red as it records a $153 million loss

Toshiba's most recent fiscal results (the first of its 2012 financial year) show that while the company pulled in $16 billion in turnover, it slumped to a $154 million loss for the last three months. While its "social infrastructure" unit (power plants, LED light bulbs and radiation detectors) generated a $107 million profit, the consumer electronics and white-goods sectors continued to lose sales. The company attributes the loss to further restructuring costs as well as pointing an accusatory digit toward the European financial crisis and concerns about power generation capacity in Japan. Despite the gloom, the company says that it still expects to hit a target of $81 billion turnover and $3.8 billion profit before March 2013.

Soccer: Cold War edge as U.S. women beat North Korea

MANCHESTER, England (Reuters) - The U.S. women's soccer team beat North Korea 1-0 on Tuesday in a politically charged Olympic clash between the isolated Asian country and the global superpower it has loathed since they fought a Cold War conflict six decades ago.

A mixture of curious Britons and enthusiastic Americans piled into the stands at Old Trafford, home of English Premier League club Manchester United, to watch the contest, with no North Korean spectators in evidence.

In contrast to last week, when the same North Korean team walked off the pitch before a match because giant screens accidentally displayed the flag of their South Korean foes, Tuesday's match got off to a smooth start.

The blunder brought politics to the fore ahead of the clash with the Americans, whose former President George W. Bush once branded North Korea part of an "axis of evil" along with Iran and Iraq.

The hostility is very much a live issue in world diplomacy, with Washington intent on frustrating the North's nuclear armaments plans and Pyongyang seemingly impervious to external pressure.

"It definitely adds a little bit of extra drama to this match, like in the Cold War when the Americans would play the Russians," said Californian Christina Gustafson, sporting a shirt and strings of beads in patriotic red, white and blue.

She was among crowds of Americans, many waving flags or wearing USA sunglasses or hats, who converged on Manchester. But the stands at Old Trafford, a 75,000-seat stadium, appeared less than a third full.

The American players smiled at supporters as they walked out onto the pitch, while the North Korean players looked straight ahead and did not smile. When the players shook hands just before kick-off, some of the Americans attempted smiles and eye-contact with their opponents, who remained stony-faced.

At the end of the match, the American players lingered on the pitch and linked their hands to do a collective wave for the fans. After perfunctory handshakes, the North Koreans jogged off the pitch in a straight line.

"NOT ABOUT POLITICS"

It would be difficult to imagine a sporting contest between two more different nations.

On the one hand, a global economic powerhouse whose cultural influence can be felt across the globe, a society hooked on 24-hour media and the Internet, a land of plenty where the number one threat to public health is the high obesity rate.

On the other, an impenetrable fortress run by a dynasty of dictators, cut off from the rest of the planet by barbed wire and strict controls over any form of communication, an economic disaster zone where millions go short of food.

During the match, mass chants of "USA! USA!" repeatedly boomed around the stadium. At one point, a group of British fans apparently in the mood to annoy the Americans shouted "Korea! Korea!" but there was no other audible cheering for the Asians.

Some of the Americans in the stands were keen to show respect to their opponents.

"The Olympics is about sportsmanship and athletics, it's not about politics," said Oliver Spandow, from Florida, who was cheering for the Americans with his wife and three children. The whole family had the Stars and Stripes painted on their faces.

"It's important to show good sportsmanship, that's what we've told the kids. The North Korean players have worked hard to be here just like our team and they deserve to be here," said Kristin Spandow, Oliver's wife.

"SEIZED WITH JOY"

North Korea is an impressive fifth in the Olympics medals table so far, drawing enthusiastic coverage from the official news agency, KCNA.

"DPRK People Seized with Joy over Successes in Olympiad," said one KCNA headline on Tuesday. The DPRK is the acronym of the North's full name, the Democratic People's Republic of Korea.

"As the DPRK flag was hoisting higher than others, I got so excited that I could hardly repress my tears rolling down my cheek," said Jong In-ho, a teacher at Kim Il Sung University in Pyongyang, according to KCNA.

Organisers of London 2012 will be relieved that there were no errors such as the flag fiasco at Old Trafford.

One supporter of the North Koreans, British pensioner David Greenhough, expressed his own frustration at the mix-up.

"I was spitting feathers over the flag incident," said Greenhough, who was carrying a large North Korean flag and described himself as an independent Marxist historian.

The North Korean women's team won the 2008 Asian Football Confederation's tournament. But they were caught up in scandal at the 2011 women's World Cup in Germany, where five of the players tested positive for banned steroids.

North Korean officials said at the time that players had taken some traditional Chinese medication based on musk deer glands to help them recover from a lighting strike during a training match in North Korea weeks before the tournament.

The North Korean men's team claimed their place in sporting history during the 1966 World Cup in England when they knocked out favorites Italy in one of the greatest upsets ever.

Tech titans face off in court over iPhone, iPad

SAN FRANCISCO (AP) ? Two tech titans will square off in federal court Monday in a closely watched trial over control of the U.S. smartphone and computer tablet markets.

Apple Inc. filed a lawsuit against Samsung Electronics Co. last year alleging the world's largest technology company's smartphones and computer tablets are illegal knockoffs of its popular iPhone and iPad products. The Cupertino-based company is demanding $2.5 billion in damages, an award that would dwarf the largest patent-related verdict to date.

Samsung counters that Apple is doing the stealing and that some of the technology at issue ? such as the rounded rectangular designs of smartphones and tablets ? has been industry standards for years.

The U.S. trial is just the latest skirmish between the two over product designs. A similar trial began last week, and the two companies have been fighting in courts in the United Kingdom and Germany. The case is one of some 50 lawsuits among myriad telecommunications companies jockeying for position in the burgeoning $219 billion market for smartphones and computer tablets.

In the United States, U.S. District Judge Lucy Koh in San Jose last month ordered Samsung to pull its Galaxy 10.1 computer tablet from the U.S. market pending the outcome of the trial, though the judge barred Apple attorneys from telling the jurors about the ban.

"That's a pretty strong statement from the judge and shows you what she thinks about some of Apple's claims," said Bryan Love, a Santa Clara University law professor and patent expert. Love said that even though the case will be decided by 10 jurors, the judge has the authority to overrule their decision if she thinks they got it wrong.

"In some sense the big part of the case is not Apple's demands for damages but whether Samsung gets to sell its products," said Mark A. Lemley, a Stanford Law School professor and director of the Stanford Program in Law, Science, and Technology.

Lemley also said a verdict in Apple's favor could send a message to consumers that Android-based products such as Samsung's are in legal jeopardy. A verdict in Samsung's favor, especially if it prevails on its demands that Apple pay its asking price to certain transmission technology it controls, could lead to higher-priced Apple products.

Lemley and other legal observers say it's rare that a patent battle with so much at stake doesn't settle short of a trial. Court-ordered mediation sessions attended by Apple's chief executive Tim Cook and high-ranking Samsung officials failed to resolve the legal squabble, leading to a highly technical trial of mostly expert witnesses opining on patent laws and technology. Cook is not on the witness list and is not expected to testify during what is expected to be a four week-trial.

Lemley, Love and others say it also appears that Apple was motivated to file the lawsuit, at least in part, by its late founder's public avowals that companies using Android to create smartphones and other products were brazenly stealing from Apple. To that end, Samsung's attorneys made an unsuccessful pitch to have the jury hear excerpts from Steve Jobs' authorized biography.

"I will spend my last dying breath if I need to, and I will spend every penny of Apple's $40 billion in the bank, to right this wrong, I'm going to destroy Android, because it's a stolen product," Jobs is quoted as saying in Walter Isaacson's book "Steve Jobs" published in November. "I'm willing to go thermonuclear war on this."

But the judge barred those statements in a ruling earlier this month.

"I really don't think this is a trial about Steve Jobs," Koh said.

In court papers filed last week, each company laid out its legal strategy in so-called "trial briefs."

Apple lawyers argue there is almost no difference between Samsung's products and Apple's and that the South Korean company's internal documents show it copied Apple's iconic designs and its interface.

"Samsung once sold a range of phones and a tablet of its own design," Apple lawyers argue in their documents filed Wednesday. "Now Samsung's mobile devices not only look like Apple's iPhone and iPad, they use Apple's patented software features to interact with the user."

Samsung denies the allegation and counter-charges that Apple copied its iconic iPhone from Sony. Samsung lawyers noted that the company has been developing mobile phones since 1991 and that Apple jumped into the market only in 2007.

"In this lawsuit, Apple seeks to stifle legitimate competition and limit consumer choice to maintain its historically exorbitant profits," Samsung lawyers wrote in their trial brief also filed Wednesday. "Android phones manufactured by Samsung and other companies ? all of which Apple has also serially sued in numerous forums worldwide ? offer consumers a more flexible, open operating system with greater product choices at a variety of price points as an alternative to Apple's single, expensive and closed-system devices."

"Between 2005 and 2010 alone, Samsung invested $35 billion in research and development relating to telecommunications technology, with over 20,000 engineers worldwide dedicated to telecommunications research and development," Samsung's lawyers wrote.

"One thing that is notable is that this trial is happening at all," said Love, the Santa Clara law professor and patent expert. He said that in an industry such as this where so many companies hold so many vital patents needed by all players, lawsuits are viewed as toying with "mutually assured destruction" and that most disputes are solved through "horse trading" and agreements to share intellectual property and royalties.

Amiable Amy: Having Bird or Fish as Pets

I always wanted to have a pet but; my preference would be either bird or fish. They are so tiny, colorful, cute and of course harmless. When hubby and I happen to pass by a pet shop, I would always go to the area of fish tanks. I like angel fish especially the emperor and annularis. Their colors are amazing so; even if they are expensive pets, it might be worth it. Flame angelfish and flame hawkish are also beautiful and I love their deep brilliant red body. Of course, I will always buy a clown fish because it is pretty, adorable and the price is really affordable.

I have no idea if I am good in taking care of pets and keeping aquarium fish but, I have been contemplating to keep fish in the aquarium as a hobby. I like having fish as my pet and when I am ready to buy them, I will make sure that I won't hurt them. Honestly, I do not see so much selection of pet birds in the pet shop here most especially parrots. I like their playful nature, beautiful colors and they can learn to talk too. It would be awesome to teach the parrot how to talk so; there will be inter-action between us. Of course, they are not harmless and tiny so; it's easy to take care of them too.

Just yesterday, we went to a pet shop nearby and I almost want to buy a 5.5 gallon aquarium starter kit. I know it is very tiny but, if I can maintain a small aquarium and keep it clean then, I can go on and buy a bigger aquarium soon enough. I do not want to be overwhelmed with taking care of the fish, feeding it and maintain the cleanliness of the aquarium for I do not have an extra time for that.

(AP) ? A man who saved his girlfriend's life at the Colorado movie shooting was remembered for his selfless sacrifice Saturday, while an aspiring sportscaster was praised for her boundless energy and an Air Force reservist as a good friend.

The girlfriend who Matt McQuinn saved by taking three bullets aimed at her wept as pastors spoke of the senselessness of the shooting spree at the suburban Denver theater where 12 people were killed just more than a week ago.

Mourners packed a church in this western Ohio town where McQuinn came from, while family and friends gathered in San Antonio on the same day to remember Jessica Ghawi and a private funeral service was held at Buckley Air Force Base in Aurora, Colo., for Staff Sgt. Jesse Childress.

More funerals are set for next week.

When gunfire broke out in the Aurora theater, McQuinn, 27, dove in front of his girlfriend, Samantha Yowler, and was shot three times.

Yowler, who was shot in the knee and survived, arrived at McQuinn's funeral on crutches Saturday and wept quietly with his parents and other family during the funeral. Neither she nor his parents addressed mourners at the Maiden Lane Church of God.

Pastor Herb Shaffer, who is also McQuinn's uncle, said his nephew had been a gift to his family since he was born, and that his actions in Colorado were just one example of his selflessness.

McQuinn called his mother three times the day before she had surgery because he was upset that he couldn't be there in person, Shaffer said. When he was just 7, he put his arm around his younger cousin because he was worried she wasn't having a good day, he said.

Then he talked about McQuinn's greatest sacrifice of all, saving Yowler, whom Shaffer described as the love of his nephew's life.

"In moments of crisis, true character comes out," he said. "His immediate response was to protect the woman he loved."

"Matt's death is a sudden loss, one that has produced many questions in your minds," Pastor Dan Fiorini said. "I know you're asking in your heart of hearts, why? Why was Matt there? Why was a gunman allowed to enter that theater? Why was he able to purchase guns and ammunition so easily? Why didn't God do something?"

Fiorini said he couldn't answer any of those questions.

"We can wrestle with the whys of this tragedy for eternity and never come up with an answer," he said.

Shaffer told mourners that the shooting forever changed them.

"Our lives will never be the same," he said. "The words Aurora, Cinema 16 shooting, Batman, will never mean the same thing, and we'll be reminded of Matt every time we hear them."

Mourners at Ghawi's funeral also touched briefly on the massacre.

"If this coward could have done this with this much hate, imagine what we can do with this much love," her brother, Jordan Ghawi, said at the Community Bible Church in San Antonio.

But most of the service focused on the life and energy of the aspiring 24-year-old sports journalist.

"What we will not do today is focus on how she left us," said Peter Burns, a friend from Colorado, reading a statement from Ghawi's mother, Sandy. "Jess was a force to be reckoned with. She was a jolt of lightning. A whirlwind. A Labrador puppy running clumsily with innocent joy."

Burns talked of the funny way Ghawi sneezed, her near-addiction to Nutella chocolate, how she was sloppy and always lovable.

Ghawi's boyfriend, Jay Meloff, note that others described her as "a tough, redheaded spitfire," and she was, but that he also saw "a beautiful, warm-hearted and passionate woman with a capacity for love. ... She was as mushy as they come."

He said they were looking forward to building a future together and he also encouraged others to do as she did and "live each day fully."

"She drank in life," he said.

Ghawi was a pretty, blue-eyed redhead who moved to Colorado about a year ago. She had survived a June 2 shooting at a Toronto mall that left two dead and several wounded. She blogged about the experience, writing that it reminded her "how fragile life was."

"I was reminded that we don't know when or where our time on Earth will end. When or where we will breathe our last breath," Ghawi wrote.

Following the funeral for Childress, 29, about 200 people attended a private burial service at Fort Logan National Cemetery southwest of Denver, Veterans Affairs spokesman Paul Sherbo said.

Friends and colleagues have described the Air Force cyber-systems operator as a good friend, experienced and knowledgeable. Childress was from Thornton, Colo., and worked at Buckley Air Force Base.

James Holmes, a 24-year-old former doctoral student studying neuroscience, is accused of opening fire on the theater, killing McQuinn, Ghawi, Childress and nine others, and wounding 58. He is due to be formally charged Monday in Colorado.

HP laptop comes with inadvertent peek at Chinese factory video

Most tours of Chinese factories at least give workers a heads-up that they'll be on camera. Not so the exposé that HP inadvertently gave one of its Swedish customers. Reddit user Malplace opened a new laptop to find that a 3-minute webcam video of the factory floor at HP's contractor, Quanta, was sitting in Windows' My Documents folder. If you're looking for scandal from the footage, though, you won't find it here: Chongqing Manufacturing City's staff are shown dutifully moving the assembly line along in what looks like fair conditions, if exceptionally repetitive. The instance is most likely just a rare gaffe during testing at a manufacturer that pumps out millions of HP PCs every quarter, so we'll cut Quanta some slack. It's still a rare glimpse into a side of technology that's considered off-limits for much of the buying public.

Gun violence shifts to forefront of campaign

WASHINGTON (AP) ? Days after the mass shootings in Colorado, guns shifted to the forefront of the presidential campaign as President Barack Obama and Republican candidate Mitt Romney engaged in their most extensive discussions on the issue since the tragedy.

Obama, in a speech to an African-American group Wednesday in New Orleans, embraced some degree of additional restrictions on guns. He acknowledged that not enough had been done to prevent weapons from getting into the hands of criminals and pledged to work with lawmakers from both parties to move forward on the matter.

Romney said in a television interview that changing the nation's laws would not prevent gun-related tragedies. But he mistakenly said many weapons used by the shooting suspect in Aurora, Colo., were obtained illegally, despite the fact that authorities allege that the firearms used to kill 12 people and injure dozens more were purchased legally.

Neither candidate strayed significantly in their remarks Wednesday from their previously held positions on gun violence. But their pointed comments revived a debate ? if perhaps only briefly ? that has steadily faded to the background in national politics and been virtually non-existent in the 2012 campaign.

The White House in particular has faced fresh questions since the shootings about whether Obama, a strong supporter of gun control as a senator from Illinois, would make an election-year push for stricter measures.

Following last year's killing of six people and the wounding of Rep. Gabrielle Giffords in Arizona, Obama called for steps to "keep those irresponsible, law-breaking few from getting their hands on a gun in the first place." But he has advanced no legislative proposals since then.

The White House blames the lack of legislation in part on congressional opposition and says Obama has used his executive powers to strengthen some gun control measures.

It's been more than a decade since gun control advocates had a realistic hope of getting the type of legislation they seek, despite predictions that each shocking outburst of violence would lead to action.

During remarks Wednesday night to the National Urban League, Obama acknowledged a national pattern of calling for tougher gun restrictions in the wake of violent crimes but not following through.

"Too often, those efforts are defeated by politics and by lobbying and eventually by the pull of our collective attention elsewhere," he said.

Obama called for stepped-up background checks for people who want to purchase guns and restrictions to keep mentally imbalanced individuals from buying weapons. Those steps, he said, "shouldn't be controversial. They should be common sense."

Still, Obama is unlikely to make a robust push for new gun control legislation while mired in a deadlocked campaign centered squarely on the economy.

Romney was pressed on gun control during an interview with NBC News in London, where he is attending the Olympics and kicking off a three-country foreign trip. The presumptive Republican nominee said changing laws won't "make all bad things go away."

Romney was asked about his tenure as Massachusetts governor, when he signed a bill that banned some assault-style weapons like the type the Colorado shooter is alleged to have used. At the time, Romney described such guns as "instruments of destruction with the sole purpose of hunting down and killing people."

Asked if he stood by those comments, Romney mentioned the Massachusetts ban but said he didn't think current laws needed to change.

"I don't happen to believe that America needs new gun laws. A lot of what this ... young man did was clearly against the law. But the fact that it was against the law did not prevent it from happening," Romney said.

Authorities have said the suspected Colorado shooter, James Holmes, methodically stockpiled weapons and explosives at work and home in recent months. He purchased thousands of rounds of ammunition and a shotgun, a semi-automatic rifle and two Glock pistols, authorities said.

On Friday, clad head to toe in combat gear, he allegedly burst into a midnight showing of "The Dark Knight Rises" at an Aurora, Colo., movie theater, tossed gas canisters into the crowd and opened fire.

The Colorado shootings also have brought fresh attention to the frequent incidents of gun violence that plague many American cities, including Obama's hometown of Chicago.

Obama addressed the nationwide troubles in front of the Urban League in part because African-Americans, who make up the bulk of the organization's membership, have been disproportionately affected by gun violence. While mass shootings like the one in Colorado receive widespread attention, Obama said roughly the same number of young people are killed in the U.S. by guns every day and a half.

"For every Columbine or Virginia Tech, there are dozens gunned down on the streets of Chicago and Atlanta, and here in New Orleans," he said. "For every Tucson or Aurora, there is daily heartbreak over young Americans shot in Milwaukee or Cleveland."

The president urged parents, neighbors and teachers to also play a role in helping end gun violence among young people.

Sprint's iPhone gamble isn't paying off as 2012 Q2 figures reveal $629 million operating loss

Sprints iPhone gamble isnt paying off as 2012 Q2 figures reveal $14 billion loss

Sprint's second quarter figures have arrived, showing that the company's billion-dollar gamble on the iPhone isn't working right now. While it sold 1.5 million Apple-branded handsets in the three month period (40 percent to new and postpaid customers), it recorded an operating loss of $629 million and a colossal net loss of $1.4 billion -- compared to an operating loss of $255 million and a net loss of $863 million in the first quarter. Operating revenues of $8.8 billion improved on those in the first quarter by a single percent -- mostly due to higher service fees from its wireless offerings. It's also grown its cash reserves, up from $128 million last quarter to $267 million today, and can point to 442,000 postpaid and 141,000 new prepaid subscribers pushing the company's customer base up to 56 million nationwide -- mentioning that 60 percent of former Nextel users chose to remain with Sprint during the enforced change.

The figures reveal that Sprint's eating around $782 million due to the shutdown of the Nextel platform and a further $184 million to end leases on antenna sites for the moribund network. It's also having to take a hit of $204 million due to its investment into infrastructure partner Clearwire. It's affirmed its $1 billion lending facility, contingent upon purchasing gear from Ericsson to help build its LTE network, which it aims to have installed in 12,000 sites by the end of the year. Of course, that purchase was prompted by the collapse of Philip Falcone's doomed LightSquared project, which caused Big Yellow to lose $66 million in cash and its childhood innocence when it comes to trusting other people.

Update: Dan Hesse has added that his company is working to take all 9,600 iDEN sites off air, well ahead of its planned deadline. Big Yellow also mentioned that have no plans to adopt a shared data plan to follow AT&T and Verizon.

Senate passes cuts for all but richest Americans

WASHINGTON (AP) ? The Senate has debated, sniped and voted on the politically fraught issue of tax cuts, and next week the House is likely to do it all over again. Still, Americans won't know until after the November elections how much more of their paychecks will go to the government next year.

House Speaker John Boehner said Thursday that his Republican-led chamber is "more than willing" to make Democrats vote on the President Barack Obama's plan to extend former president George W. Bush's tax cuts for all but the wealthiest Americans. He also is bringing up the GOP's proposal to extend the tax cuts for everyone.

The outcome is almost certainly stalemated until the November elections, so leaders of both houses of Congress are turning the House and Senate into campaign stages on one of the defining issues of the presidential and congressional races.

Obama signaled on Thursday he's ready to do his part to light a fire under lawmakers. "I would urge the House of Representatives to do the right thing," he told reporters during a Cabinet meeting. He said he and top aides will "amplify that message" in the days to come.

Obama said the one-year extension would provide "certainty and security to families who are already feeling pinched" and reassure businesses by taking "a whole bunch of uncertainty out of the economy" at a time of global economic worries.

The Senate opened the drama Wednesday with surprise debates and passage of a Democratic bill fashioned on President Barack Obama's proposal to extend the income tax cuts to all but the wealthiest Americans through 2013. It passed even though the measure stands no chance of surviving the Republican-led House. Meanwhile, the Senate rejected a GOP amendment to extend the cuts to all taxpayers. House Speaker John Boehner, R-Ohio, intends to bring up that measure in his chamber next week.

So the matter was a nearly certain stalemate even before Democratic leader Harry Reid and Republican leader Mitch McConnell abruptly agreed to vote on two measures, spent the day accusing each other of playing politics and the last 20 minutes trying to get the last word.

"We know this is about the election," McConnell said. At one point he resolved to let Reid close the debate but then changed his mind to dispute a point.

"Here we go again," Reid muttered. Some of McConnell's remarks, he added, were "poppycock."

Despite the drama, the issue carries great significance for voters deeply worried about their finances as the economy struggles to recover from recession. Which way the debate goes could mean a big difference: an average of $1,600 a year in taxes for 114 million middle-class families, according to the White House.

The electorate is deeply divided over the tax cut issue.

A CBS News/New York Times poll conducted July 11-16 found that nearly half of Americans, about 49 percent, would prefer that the 2001 and 2003 tax cuts continue only for those households earning less than $250,000 a year, as Obama and congressional Democrats want. An additional 17 percent think the cuts should expire for everyone. And 27 percent say the tax cuts should be continued for all taxpayers, as Republicans want.

Wednesday's Senate vote on the $250 billion Democratic bill was a near-party line 51-40 tally, with Vice President Joe Biden presiding over the chamber in the unlikely event his vote was needed to break a tie. Minutes earlier, senators voted 54-45 to reject the rival Republican package that would have included the wealthiest Americans in the tax reductions.

"With the Senate's vote, the House Republicans are now the only people left in Washington holding hostage the middle-class tax cuts for 98 percent of Americans and nearly every small business owner," Obama said in a written statement.

The vote served as a counterpoint to the GOP-run House, which next week will pass tax cuts nearly identical to the $405 billion Republican plan the Senate rejected Wednesday.

Republicans say raising taxes on higher earners saps money from business owners who would otherwise create jobs. Democrats say that's overblown.

"The House will vote next week to stop that tax hike, and until the Senate does the same, the threat to our economy remains," Boehner said in a statement.

Though the House and Senate votes are mostly for show, they pose challenges to some lawmakers in tough re-election campaigns.

The Democratic bill would dramatically boost the estate tax, which would be widely unpopular in farming, ranching and high cost-of-living states. It also would increase levies on dividends and capital gains, which are relied on by many elderly people.

Sen. Claire McCaskill, D-Mo., who is in a difficult re-election race, announced she had introduced a bill preventing the estate tax from rising next year. She issued a news release to that effect just minutes after voting for the Democratic bill, which would let estate taxes rise in 2013.

Under the Democratic measure, individuals earning more than $200,000 and couples making over $250,000 would see their top rates rise from 33 percent and 35 percent today to 36 percent and 39.6 percent in January.

The Democratic bill would also boost the top tax rate paid by people who inherit estates to 55 percent, exempting the first $1 million in an estate's value. The GOP measure would maintain today's 35 percent top rate and would not tax the first $5.12 million of an estate's value.

In fresh figures released this week by Republicans, Congress' nonpartisan Joint Committee on Taxation estimated that the Democratic provision would affect 55,200 estates next year, compared with 3,600 who would face estate taxes under the GOP plan.

Democrats would impose top tax rates next year of 20 percent on dividends and capital gains, two sources of income enjoyed disproportionately by the wealthy. The GOP top rate would be 15 percent.

The GOP bill ignores some tax credits for low- and middle-income families that Democrats want to extend for college costs; for some low-income couples and large working families; and for families with children.

Workers' Comp. Mooching Off Other Insurers; Federal Government ...

As your humble blogger?s endless web of spies, informants, and double agents (collectively known as the internet), were bringing him reports of all the workers? compensation doings going on in the world, an interesting gem was stumbled-upon.? It appears that a new study has been published regarding the shifting of expenses in workers? compensation.

The research apparently included statistics from across the country, and looked at the costs absorbed by insurers and self-insured employers, as well as the overall costs shifted to third parties such as Medicare, Medicaid, and non-workers? compensation insurance.? Lexis provides a nice summary of the study here.

Picture your typical worker contemplating a settlement proposal.? The worker knows that he or she is going to need some future medical treatment, but if a third-party is going to end up paying for it, perhaps those funds could be split between the defense and the applicant?

Your humble blogger has personally observed an in pro per applicant being advised that, if he had personal health insurance through his employer or through his spouse?s employer, perhaps he could bargain away the right to future medical treatment for cash-on-hand. ?And in other cases, a very unhappy lien representative lawyer for a certain non-workers? compensation insurance company sat as the other parties practically high-fived each other over reaching an agreement by shoveling medical expenses onto the third party.

It also seems to be common practice to shoot for a settlement figure two cents under $25,000 to avoid CMS intervention in a case, and allow the Federal Government to pick up the tab of future medical treatment.

Ethical issues aside, this isn?t a particular badge of honor as to the efficiency and sustainability of the workers? compensation system.? One cannot operate a widget factory by stealing widgets from the more sustainable factories in the neighborhood. ?Sooner or later, they?ll start locking their doors.

The study apparently found that almost $27 billion of $51.7 billion estimated in workers? compensation costs for 2007 were absorbed by third parties.

We might all pat ourselves on the back, join hands with applicants? attorneys and lien claimants, and laugh at those poor suckers picking up the slack for comp.? But, before we tap the kegs and light the cigars, your humble blogger, ever the pessimist, would just like to point out a small fact:? workers? compensation is too expensive in its current state.? (Ok, NOW we can tap the kegs!)

Even with poor bystanders getting stuck with the bill, workers? compensation is still too expensive and keeps losing money.? Reserves must consistently be replenished and the industry continues to suffer across the board.? What will happen when these third parties wise up and stop carrying half the Kool-Aid bottles that the comp world is drinking?

While the ship is still afloat, let?s drain some of the water in the decks instead of tying ourselves to more sea-worthy craft.

A 3.8% sales tax on real estate in the health care law? | Tampa ...

Did you get the chain email that claims the health care law will institute a new tax on home sales?

Here?s the email many readers have forwarded to us:

?Under the new health care bill ? did you know that all real estate transactions will be subject to a 3.8% Sales Tax? The bulk of these new taxes don?t kick in until 2013 (presumably after Obama?s re-election). You can thank Nancy, Harry and Barack and your local Democrat Congressman for this one. If you sell your $400,000 home, there will be a $15,200 tax. This bill is set to screw the retiring generation who often downsize their homes. Is this Hope & Change great or what? ?Continue Reading

Apple OS X 10.8 Mountain Lion

Just like the last few versions of Apple's laptop-and-desktop operating system, OS X Mountain Lion ($19.99) came out of the gate this morning as the best consumer operating system there is.

At first glance, Mountain Lion looks like an identical twin of its predecessor, OS X Lion. Upgraders from Lion will face an almost flat learning curve, because almost every feature they've learned to use works in almost exactly the same way as before. But Mountain Lion unobtrusively slots in dozens of new features?Apple counts two hundred of them?that enhance sharing, messaging, cloud-based synchronization, security, Web browsing, instant notifications, and accessibility.

When installed on the latest Mac hardware?recent MacBook Air models and the new MacBook Pro with Retina display?Mountain Lion even keeps working while the computer sleeps, downloading software updates, messages, mail, and much else while the laptop's lid is closed and its lights are off, so the system is up-to-date the moment it wakes up. Mountain Lion isn't perfect, but it leaves the consumer competition so far behind that you'll need to look hard for convincing reasons to use anything else.

While adding security and sharing features that make it a more powerful system for getting work done, Mountain Lion also makes some convincing advances on Windows' throne as the leading platform for playing games. The new OS makes it easy to use a Mac as a high-powered game console and media center, easily sending its screen to an HDTV connected to an Apple TV add-on box. Though Apple won't say a word about it, this "AirPlay Mirroring" feature clearly looks forward to a future TV manufactured by Apple itself.

Apple charges $19.99 to download Mountain Lion from the App Store and?for that single one-time payment?you can upgrade all your existing Macs from OS X Snow Leopard or OS X Lion. If you recently bought Mac?on or after June 11, that is?don't kick yourself: your upgrade is free. Don't bother trying to buy Mountain Lion on a disk; it only comes on a new Mac or via the App Store. If you buy a MacBook Pro with Retina display with Mountain Lion installed, be warned: you may spend so much time feasting your eyes on Mountain Lion's high-resolution desktop backgrounds that you won't get any work done. I only stopped being distracted by the gorgeous imagery when I changed my desktop background to a solid color.

A Different Approach
Compared with last year's debut of OS X Lion, what's different is that, this time, Windows 8's release is imminent (it's currently available as a Release Preview). While Mountain Lion wins as a consumer OS, it will also be extremely interesting to see just how much attention it gets from businesses, too?especially smaller businesses that wouldn't take advantage of the Windows Server 2012.

Adjusting to a Family Member Returning from Deployment

A parent returning home from deployment is an exciting, joyful time. While family members are happy to be reunited, the initial excitement eventually wears off and families are left to figure out how to readjust to the change.? Every member of the family has changed and grown over the course of the deployment so be patient when it comes to reestablishing connections and routines. Everyone will need some time. There are many things you can do to make the adjustment period as smooth as possible.

  • Limit the surprises. Keep the deployed family member up to date with any changes you?ve made to the house or changes in the family?s schedule. Keep them in the loop even when they can?t be there to help with the decisions so when they come home they are not hit with many changes at once.
  • Listen and reconnect. Everyone has been operating in different environments so it will take time to readjust being together again. Be honest about sharing feelings and listen to the needs of the returning member.
  • Communicate! Open discussion of expectations prior to returning home are helpful if possible. Discuss responsibilities you each have now (finances, child care, etc.) and have they will change after deployment.
  • Approach discipline as a team. One of you has been the main disciplinarian for a while but now that both of you are there, it?s important to discuss what you both think are appropriate responses to bad behavior. If you are the returning parent gradually step back into the disciplinary role as your child is now used to discipline coming from the other parent and may be confused or defiant if you try to take over immediately.
  • Plan family activities. Enjoy your time together. Go to the park, play board games, go on a bike ride, draw, etc. Doing activities together can help everyone reconnect as a family.
  • Get involved with caretaking again. If you were the one gone try changing diapers, help kids get ready for school, or drive them to their activities. This can help to reestablish a routine and help you get used to home life again.
  • Utilize help offered by the military. The military and other organizations can direct you to many resources to help adjust to life after deployment. Remember they are there to help!

Children may need a period of time to warm up to the returning parent, as this time can be overwhelming and confusing for them. Their developmental level will influence their response to the returning family member. Toddlers may not remember the parent well, school age children may not understand a parent?s need to take care of themselves and spend time with their spouses, and teens may seem distant as they carry on their activities with friends so let children readjust on their own time.

Quick tips:

  • Don?t force hugs or play time
  • Listen to what they tell you and accept their feelings
  • Talk about things they are interested in
  • Make time to play together if they want
  • Reinforce your love for your child (hugs, kisses, etc)
  • Spend time reviewing schoolwork, pictures, etc that were done while you were gone.
  • Praise them for what they?ve accomplished during the deployment
  • Have respect for their privacy and friends
  • Encourage them to share what has happened in their personal lives but don?t push or criticize.
