breaking: Federal online gambling bill posted by U.S. Rep Pete King ...

New York politician Pete King today introduced the Internet Gambling Regulation, Enforcement, and Consumer Protection Act of 2013 in the House of Representatives, a bill designed ?to create a uniform regulatory framework to control the activity and protect consumers.?

The new legislation would ensure Internet gambling is not governed by ?inconsistent state laws adopted since the Department of Justice?s opinion in December 2011 that the activity is not prohibited under federal law unless it involves sports,? King added in a press release. ?It is not uniformly regulated, the operators are not licensed, and consumers lack protection from fraud and abuse. With states approaching this issue piecemeal, it can lead to conflicting or inconsistent laws from state-to-state, varying levels of consumer protection, and a perverse incentive for a race-to-the-bottom on standards to attract gaming operators and revenues.?

King?s bill was lauded by the Safe and Secure Internet Gambling Initiative, which backs the regulation of Internet gambling regulation ?to protect against underage gambling, compulsive gambling and fraud, while laying the groundwork for the creation of thousands of new jobs and generation of billions to stimulate U.S. economic expansion.?

?I?d be shocked if Congress didn?t move quickly to consider this new legislation, which is desperately needed to create uniformity across the country and protect consumers regardless of where they are located,? said Michael Waxman, spokesman for the Safe and Secure Internet Gambling Initiative.

But Chris Grove of onlinepokerreport.com just tweeted that after read summaries by quadjacks and by the Poker Players Alliance, ?This thing seems 100% DOA? ? meaning ?Dead on Arrival.?

[Interesting wrinkle noted by Grove: "Under King bill, states are opted-in to federal online gambling UNLESS they notify feds they want out within 120 days"]

Chris Krafcik of Gambling Compliance tweeted that: ?Multiple lobbyists say Rep. King?s Internet gambling bill is a ?placeholder? with little chance of advancing.?

Among other things, King says the bill is designed to ?apply tough penalties to unlicensed operators? to put them and their off-shore, untaxed, unregulated services, out of business, forever? and to ?shut down money launderers and criminals seeking to use internet gambling to move funds.?

The bill has the backing of the Poker Players Alliance.

?Congress cannot ignore progress and the facts. Americans want the freedom to play online poker in a regulated market and states are filling the void. Already three states have authorized online gaming and several more are on the precipice of joining them,? said John Pappas, executive director of the PPA. ?Poker players recognize the benefits of a federal law over the current state-by-state approach.?

Modeled after legislation approved by a 41-22 vote in the House Committee on Financial Services in July 2010, Rep. King?s bill would assign licensing and enforcement responsibility to a new Office of Internet Gambling Oversight within the Department of the Treasury, according to the initiative.

?Previous attempts by Congress to prohibit Internet gambling have failed, leaving millions of Americans who continue to gamble online without any guaranteed protections or safety net,? said Waxman.

The move comes with Nevada having debuted online poker earlier this spring, and with Delaware and New Jersey poised to offer a variety of online versions of casino games before the end of the calendar year.

Howard Stutz of the Las Vegas Review-Journal reports: ?Under the proposed legislation, a federal regulatory structure would be established, while grandfathering any existing activity that is limited to the geographic confines of a state, such as laws in Nevada, Delaware, and New Jersey.?
