Julie Stewart: Justice Should Apply to All, Not Just Juveniles

On June 25, the U.S. Supreme Court held in Miller v. Alabama that mandatory life without parole sentences for juveniles are unconstitutional because they violate the 8th Amendment's ban on cruel and unusual punishments. The Court got the result right, but it was the reasoning of Justice Elena Kagan's majority opinion that grabbed my attention. It expresses perfectly the problems not just with treating juveniles as adults, but also with using mandatory sentences to treat all offenders as if they are the same.

In fact, much of the Miller opinion sounded familiar, because it echoes what my organization, Families Against Mandatory Minimums (FAMM), has been saying for over 20 years. Mandatory sentences don't allow judges to consider all the unique, intricate details of each crime and each offender -- including whether he is a juvenile. These one-size-fits-all penalties apply to a growing list of crimes (murder, drug offenses, gun possession) and are triggered whenever that charge is brought by a prosecutor. The prosecutor becomes the judge because the charge decides the sentence. The result is what all too often happens with anything labeled "one size fits all": for many people, the punishment is too big, too long, excessive -- and, by definition, cruel and unusual.

A mandatory life without parole sentence for juveniles is unconstitutional, Justice Kagan writes, because it does not allow judges to consider not just the offender's "chronological age and its hallmark features -- among them, immaturity, impetuosity, and failure to appreciate risks and consequences," but also the offender's "family and home environment" and "the circumstances of the homicide offense, including the extent of his participation in the conduct." But all of these factors are crucial to imposing an appropriate sentence in any case, for any crime, for any offender, at any age. And mandatory sentences ignore them all.

Justice Kagan goes to great lengths in the Miller opinion to validate a 1991 Supreme Court case, Harmelin v. Michigan, which held that mandatory minimum life without parole sentences were not cruel and unusual punishment -- even for the hundreds of first-time, nonviolent, low-level Michigan drug offenders receiving them in those early, frenzied days of the War on Drugs. (FAMM eventually succeeded in advocating for Michigan's reform of that law, as well as most of its other mandatory sentences for drug crimes.) The difference between Miller and Harmelin, Justice Kagan said, is that the killers in Miller are children, and drug offender Harmelin was an adult. Indeed, she writes, it appears that just as "death is different" in Supreme Court cases, "children are different too."

But why should Justice Kagan's otherwise sound sentencing logic -- that people must be sentenced as individuals -- only apply to juveniles? Why is it permissible to strong-arm judges into giving a mandatory life without parole sentence to an 18 year-old, but not to a 17 year-old? A mandatory minimum sentence is no less unjust, no less disregarding of the facts and circumstances of the crime and the offender, and no less cruel and unusual if the offender is 19, 27, 45, or 90. Age is an important sentencing factor, but it should not be the divider between constitutional and unconstitutional mandatory minimum sentences.

Ask any prisoner and her family: each and every day of mandatory punishment that is more than necessary and merited, is cruel and unusual punishment. To be sure, sentencing is an inexact business. There is no single, ideal sentence for each crime and offender. But our current system sends first-time drug offenders to prison for decades and requires life sentences for many people who pose no threat to anyone's physical safety. This excess -- and the indiscriminate way it is meted out -- is a flagrant violation of the Constitution's requirement of proportional punishment.

The Miller opinion opens the door for a renewed look at Harmelin and the constitutionality of mandatory minimum sentences. For over two decades, mandatory sentences have sapped judges of the power to do what Miller demands: give people the dignity of punishments that fit them and their crimes. If depriving someone of that most basic principle of American justice is not cruel and unusual, the 8th Amendment is poor protection for all of us.

Mexico's Pena Nieto wraps up campaign with victory near

TOLUCA, Mexico (Reuters) - Mexico's presidential front-runner Enrique Pena Nieto scented victory as he wrapped up his campaign on Wednesday with polls showing he should easily win the weekend election and put the country's old rulers back in power.

Voters elect a new president on Sunday and many are eager for the next government to fire up an underperforming economy and end rampant violence by drug gangs, sore points that have eroded confidence in the ruling National Action Party, or PAN.

Pena Nieto is running for the opposition Institutional Revolutionary Party (PRI), which laid the foundations of modern Mexico and ruled for most of the 20th century but is widely remembered for its corruption and suppression of dissent.

The PRI was ousted by the conservative PAN in a 2000 election, but has bounced back in the last few years, insisting it has learned from its mistakes and swinging the full might of its formidable party machinery behind the telegenic Pena Nieto.

The PAN raised high hopes when it came to power, but annual economic growth averaged barely 2 percent under its two governments and it has failed to contain spiraling criminal violence, crippling its hopes of a third term.

"We want a country that lives in peace, is calm and is safe," Pena Nieto, 45, told tens of thousands of supporters in the central city of Toluca on the last day of campaigning.

Three polls published on Wednesday all showed him with a double-digit lead over his rivals.

Wearing red baseball caps and red and white T-shirts handed out by the party, supporters shouted "Presidente, Presidente" as Pena Nieto took the stage in Toluca. But the rally was otherwise largely subdued.

"We have to give the PRI another chance, the PAN has shown it was not up to the job," said Ignacia Rodriguez, 50, a street vendor in Toluca. "They've failed the test."

Pena Nieto's closest rival is leftist candidate Andres Manuel Lopez Obrador, a former mayor of Mexico City who narrowly lost the 2006 election to President Felipe Calderon and then contested the results, staging months of protests that unnerved investors in Latin America's second-largest economy.

He has recently stirred up fears of new unrest, accusing the PRI of trying to rig the vote, although any protests may be short-lived if Pena Nieto wins by a wide margin.

The prospect of that victory fills some Mexicans with fear that the country is heading back towards a state dominated by one party.

"Lopez Obrador is the only option not to return to a dictatorship," said drama student Mezli Gutierrez, 24, as she joined thousands marching to a closing rally in Mexico City's main square. "The PRI is a completely rotten system."

PAN candidate Josefina Vazquez Mota told supporters at her final campaign rally near Mexico's second city Guadalajara that voters needed to be mindful of foul play on Sunday.

"I invite you all to be election observers, so no-one's vote is manipulated and no-one feels pressured," she said.

NEW PRI

Pena Nieto underlined his commitment to change in an interview published on Wednesday in the newspaper El Universal.

"There is a new PRI ... It's the others who have not changed. They are living in the past," he said. "But the PRI never left. It has lost and won, competed democratically and understood change."

Calderon's struggles with the sputtering economy have been exacerbated by the PAN's lack of a majority in Congress.

He has been unable to push through many of his planned reforms due to opposition from the PRI and other parties, and the brutality of drug war violence has eroded his standing.

Rampant violence between drug cartels and their clashes with the state has claimed more than 55,000 lives since 2007.

Calderon sent in the armed forces to bring the gangs to heel soon after taking office in December 2006, but despite capturing or killing many top bosses, the bloodshed has escalated.

Pena Nieto is planning to boost growth with reforms similar to those his party helped thwart in Congress under Calderon.

He has pledged to overhaul the tax system and open up state oil monopoly Pemex to more private investment in exploration, refining and production, breaking with traditions of the PRI, which nationalized Mexico's oil industry in 1938.

Recent polls suggest the PRI could win a working majority in both the Senate and lower house of Congress.

But even if he has the majorities, Pena Nieto faces a challenge to shake up Pemex, which is struggling with a heavy tax burden, bloated workforce and oil fields in decline.

A close result would raise the risk of demonstrations, particularly as Lopez Obrador has the support of a newly emerged student movement that shook up the campaign with huge rallies.

In Mexico City, banners peppered the main thoroughfare, which Lopez Obrador brought to a standstill with post-election protests six years ago, reading: "I remember the devaluations, the killings, the corruption. Don't vote for the PRI."

Some protesters vowed to take the streets again if Lopez Obrador issues a rallying call.

Mexican financial markets have already factored in a Pena Nieto win, so a close finish that puts his mandate and economic reforms at risk could spook investors and hit asset prices.

The final three polls of the campaign gave the PRI candidate a lead of between 10 and 17 points over Lopez Obrador with the PAN's Josefina Vazquez Mota trailing in third.

They were conducted between June 21 and 25 using samples of 1,200 to 2,000 eligible voters. The margin of error for the polls was 2.9 percentage points or lower.

Papier-m?ch?, not plastic, part of Victoria's greening of Canada Day

Cyclists often feel like second-class citizens on the roads ? but at the upcoming Canada Day celebrations, they?ll be treated like the valet-parking elite.

New this year, the city will provide valet service to cyclists by the legislature. It will allow people to leave their bikes with an attendant who will wheel it away to a secured area, said Amanda Wilcox with Fan Tan Group, a company contracted by the City to host the Canada Day celebrations.

No bike lock is necessary ? just show photo ID and receive a ticket to claim your bike later in the evening.

?I think a lot of people would love to bring their bike, but they don?t want to worry about it if they?re going to be downtown for a while,? said organizing committee member Coun. Charlayne Thornton-Joe.

Bike valet is just one of several new initiatives to make the two-day, city hosted Canada Day festivities more environmentally friendly.

Fireworks company Pro Fx is replacing the plastic casings on its fireworks with ones made of papier-m?ch?.

All food vendors at the international food court at Ship Point will be required to use compostable containers. The City is also supplying not just garbage cans, but recycling and compost bins as well.

?The Canada Green Team will be around with a bunch of recycling bins, ensuring that all recyclables are returned to their proper containers,? Wilcox said.

The Bottle Depot will collect the beverage containers and donate the proceeds to the Cops for Cancer Tour de Rock.

These green initiatives have added a little more cost, but they also likely attracted new sponsors, Thornton-Joe said. This year the event has more financial support than in previous years.

Thornton-Joe has been involved in the celebrations since 2000, when she was president of the Greater Victoria Inter-Cultural Association. In that year, ICA took over the celebrations from the Chamber of Commerce.

When Thornton-Joe joined city council, the file stayed with her and she?s continued to ensure the city?s diversity is reflected in the event through its performances and food.

?For me, I got involved because I took it for granted, being born and raised here, about being Canadian,? she said. That changed through her work with the ICA where, she said, ?you meet people who have left their homes to come to Canada for a better life.?

Canada Day by the numbers

This year?s Canada Day celebrations have a $200,000 budget, up from $175,000 last year.

That?s thanks to a grant to bring in Montreal-based bilingual hip hop group, Radio Radio, which headlines the mainstage July 1. The Province of Quebec and Francophone Affairs B.C. supplied $20,000 to bring the act to Victoria.

?It?s an expensive party to throw, but it?s something the local businesses have picked up on in a big way,? said Jeff Day, cultural services co-ordinator for the City.

Sponsorships and grants make up $175,000 of the budget. The City contributed $25,000, plus in-kind services such as street cleaning.

Living Flag duties taken over for 2012

This year, the City has rescued the annual living flag event from former organizers, the Downtown Victoria Business Association.

To participate, wear red or white shirts and head to the legislature grounds by 2 p.m. on July 1 to be photographed with about 2,000 others in formation of the Canadian flag.

At noon, the city will hand out 1,000 shirts to participants without red or white clothing.

A look at version 3.0 of Noom Weight Loss Coach

Weight Loss Coach lets people set their weight goals and allows people to log in their food intake and activity in a simple manner. But it can dispense advice, tasks and tips based on a few entries. Each day it gives people reminders to exercise and log meals and then throws in extra optional challenges, quizzes, suggestions and stories, based on how they?re doing. An iPhone app is planned though there is no set date as most of the company?s resources are still focused on its Android apps.

Saeju Jeong, Noom?s CEO and co-founder, said the key is ensuring that people don?t get bored and find reasons to drop the service. He said the goal is to go after the 85 percent of people who don?t regularly exercise and keep them engaged over long periods of time. He said 70 percent of Weight Loss Coach?s users are women.

The story of how Jeong and Petakov got together is interesting in itself. Petakov, who founded the user-created Maps project for Google Maps, met Jeong at a dinner party at Princeton in 2005. Jeong was in New York, working as a producer for the international production of Bye Bye Birdie. He had previously tried running his own online shopping site in his native South Korea. The two got to talking about building a health startup and eventually they founded WorkSmart Labs, which changed its name to Noom in December. The company was initially focused on bringing innovation to the gym business but they found that dealing with hardware manufacturers was slow going. Smartphones, however, provided the perfect blend of mobile sensors and computing, Jeong said.

?We realized the smartphone has all the features you need ? why buy something different?? he said.

Noom is part of a new generation of mobile health products that are designed for more casual use. Massive Health has helped to improve people?s diets with its Eatery app, which lets people take pictures of their meals and get ratings on healthiness of their diet from other users. Striiv, a smart pedometer, is going after the Zynga audience with its gamified device, which includes a Farmville like mini-game. What?s cool to see is that these products don?t simply revel in data or demand a lot of input. They work to find creative and fun ways to push people to get healthy. That?s more inviting for casual users, who want some feedback and motivation but can?t always be counted on to record a lot of information. And it?s potentially more effective over the long run, said Petakov.

?Wellness is long-term activity, so cracking the code involves long-term stuff,? he said.

I have heard it time and time again, particularly since the passage of the stimulus bill that we got roughly at 11 o'clock on a Thursday night and were required to vote on in less than 24 hours?my constituents are saying: Is it asking too much to have you read the bill before you vote on it? I voted no on that bill for a lot of reasons, but I didn't have the time, nor I suspect did many Members of Congress have the time, to read it before we were required to vote on it.?

I am very excited to have my old friend attorney Anthony Timpano visiting us today to answer several of your legal questions. The publishing business has become more complex than ever ?especially with the?proliferation??of self-publishing vehicles, fan-fiction sites, social media outlets, foreign publication rights, and the rise of multi-media distribution deals. ?Tony has been on both sides of the negotiating table having worked for both large media corporations and representing talent. ?With over 20 years in the business Tony has generously offered to lend his experienced voice to answering your questions.

OVERVIEW

It is not uncommon that I am approached by client writers regarding the use of third-party intellectual property in works that they (the client writers) intend to create or have created.? Most commonly, the concern is whether or not the client?s intended use of another?s copyrighted written work (e.g., a stanza from a poem, a paragraph from a novel, lyrics from a song)? requires clearance (obtaining authorization) ?from the copyright owner/controller of the prior written work.? Sometimes, the issue doesn?t involve copyright issues at all, and is one that must be examined under relevant state law or federal trademark law.? While each scenario should be examined on an individual basis (an examination which should be done in consultation with an attorney versed in intellectual property and media law), a writer would be well-advised to familiarize himself/herself with relevant laws to avoid any potential conflicts that could create obstacles to publication.

In an effort to provide a broad illustration of the varying issues that client writers often face, I have selected a few questions posed by members that serve as working examples.? By no means are the answers provided below intended to be an exhaustive recitation of applicable law and are not intended to provide legal advice to the inquiring party or the reader. The information provided is strictly for illustration purpose only and should not be relied on as legal advice or as a substitute for legal counsel.

QUESTIONS FROM OUR WRITERS:

1.????? I?ve written a novel in which I quote a fragment of a line from The Love Song of J. Alfred Prufrock by T. S. Eliot, about 10 lines from Dover Beach by Matthew Arnold, an entire poem by Robert Louis Stevenson and the last verse of Reluctance by Robert Frost. These authors are all dead, and my publisher does not think I need permission. Is he correct??

This question raises multiple copyright concerns, including issues that may be impacted by foreign intellectual property law, and possibly international copyright treaties (Matthew Arnold was a British Subject, Robert Louis Stevenson was a Scotsman, T.S. Eliot was born an American, but later became a British Subject (the country where these prior works were created is relevant to a thorough legal analysis). ?For purposes of this discussion, we?ll examine this question under a hypothetical assumption that these underlying works were authored in the U.S. and that U.S. Copyright Law governs.

The heart of this question is whether the author?s death is relevant to the ?term? of copyright for each of these works (i.e., whether these works are subject to copyright protection or whether they have fallen into the public domain by virtue of an expiration of the copyright term).?? If the work is not in the public domain, then permission may be required (unless the use is within the scope of ?fair use? (as discussed below).

Under current copyright law, the term of copyrighted works created by individuals (opposed to those created by corporations or some other legal entity) in the U.S. is measured, in some cases, on the life of the author plus a statutory period of time (for works created under the 1976 Copyright Act, the current term of copyright for individual works is life of the author plus 70 years). ?So, if we were dealing with works subject to the current Copyright Act, the date of the author?s death would be relevant to the analysis, but that is not the case.? All of the prior works referred to in the question were created prior to the enactment of the 1976 Copyright Act, and depending on their date of publication, may be subject to protection as a work originally governed by the 1909 Copyright Act (some of the cited works pre-date 1909 and therefore would be public domain, assuming for our purposes that the U.S. was the country in which they were authored).

The term of the 1909 Copyright Act was divided into two 28 year periods (which ran from the date of publication) that required renewal by the copyright proprietor following the initial 28 year period.? Failing to renew the copyright for the renewal period placed the work in the public domain (it is important to note that some works of note fell victim to this hole in copyright protection and fell into the public domain).

In 1998, the Copyright Term Extension Act (also known as The Sonny Bono Act) extended the term of active 1909 copyrights by an additional 20 years; effectively giving 1909 works copyright protection for a period of 95 years from date of publication (in practical terms, it means that works published in 1923 or afterward that are still subject to copyright protection won?t fall into the public domain until 2019 or afterward).? So, even though some of these authors have been dead fifty years or more, that does not mean their works are part of the public domain.

As you can see, without conducting a proper copyright search, there is no definitive answer based?solely?on the fact that the author?s have passed on.? (And remember, this analysis is limited to a hypothetical-at least some of these works are foreign works which are/were subject to the term of copyright in the country of authorship.? An analysis of copyright under applicable foreign law and international treaties would have to be done).?

2.????? Exactly how much text can be written about a specific property in a novel before permission is needed? I?ve been told by publishers less is better.

Section 106 of the Copyright Act grants to the owner/controller of copyrighted works the following exclusive rights: to produce copies or reproductions of the work and to sell those copies; to import or export the work; to create derivative works(works that adapt the original work); to perform or display the work publicly; to sell or assign these rights to others; to transmit or display by radio or video.?? Each of these ?exclusive rights? means that only the copyright owner/controller is free to exercise those enumerated rights, and others are prohibited from using the work without authorization.

Not to lose hope, there are codified limitations on the owner/controller?s exclusivity which enables other to use all or a portion of the work under limited circumstances.? Some of these limitations can be found under what is called the ?Fair Use? exceptions under Section 107 of the Copyright Act (some examples of what has been considered to be ?fair use? include commentary, criticism, news reporting, research, teaching, library archiving and educational purposes).?? This limitation on the exclusivity provides for the ?unlicensed (but legal) citation or incorporation of copyrighted material in another?s work under a four-factor balancing test:? the purpose of the work (usually viewed in terms of commercial or non-commercial use), nature of the original work, amount and substance of work used, and the potential market effect the use has on the original work.

While the ?fair use? test seems rather straight forward, the vagueness of the language in the law provides less than a bright-line test for infringement. ??In application, the courts have emphasized certain prongs of the test with greater weight as determined by the salient facts of the matter at hand.? That being said, as a general ?rule of thumb?, the more the underlying work is copied, the greater the chance that the use falls outside the protection of ?fair use?. With that being said, there are no specified numbers of words, lines or paragraphs that can be taken from ?another?s work without permission.

3.????? What are the rules on using (e.g. mentioning) ?intellectual properties in a novel? I?ve always been told by publishers the product or property has to be mentioned in a good way. No negative feedback. Can you clarify this rule please?

The use of a company?s name, product name, logo or slogan without authorization gives rise to potential claims under state laws (usually under a theory of unfair business practices, common law trademark, etc.) and/or federal trademark law.? Federal trademark law (and to the extent state laws are modeled after the federal law, state laws as well) allow a limited ?fair use? of another?s trademark/service mark for limited purposes such as comparative advertising or other nominative uses (e.g., factual reference).?? If a company?s name or product is used in a negative light or false light, then the use may be actionable as libel (in some cases libel per se).? Each intended use should be reviewed carefully in consultation with a qualified attorney.

4.????? Do I need to copyright my manuscript before sending it to a publisher and/or an agent?

?Under U.S. Copyright Law, a copyright in an original work of authorship is created as soon as the expression of the idea becomes fixed in some tangible form.? In short, you have copyright protection in your manuscript without registration.? That being said, the registration of your manuscript with the Copyright Office provides greater protection in terms of your legal remedies against potential infringers (for example, the right to claim statutory damages).? Registration also provides one very important thing; it provides a date of authorship which can be used to defend against/pursue claims of infringing works created after the date of authorship. (Nota bene:? do not rely on a self-mailed, post-marked envelop for proof of date of authorship.? This so-called ?poorman?s copyright? has been held inadmissible in copyright cases).

5.????? I?m working on a paranormal thriller and I want to put on the trial of the century. I was thinking Thurgood Marshall on the bench and Clarence Darrow defending. Would I need special permission from anyone to use famous dead guys in my story?

Briefly, the answer to your question is yes.?? The right to commercially exploit the a name of a celebrity, even a dead one, is governed by so-called rights of publicity;? generally ?matters that fall under relevant state laws (if the name is also a registered trademark, legal action could be brought under federal trademark law).? Generally, the rights are treated as a property right that may survive the celebrity?s death.? Since laws vary state-by-state, I would seek authorization from the proper parties before proceeding.

6.????? I?m thinking of making my own book trailer. Do I need to get permission to use the background song??

?The right to synchronize songs/audio recordings to visual images or motion pictures requires two separate licenses;? a synchronization license from the songwriter(s) and/or music publisher(s) and a master use license from the owner of the sound recording (the record company/production company or artist if the artist is not signed to a label).

What's your latest passion?

One of the most powerful messages coming out of the brain fitness science these days is that having intellectual passions is a major factor in any good brain fitness plan. Things we do to "stretch" our minds force us to think differently or look at the world through a constantly evolving lens. While on the surface such activities seem like the most obvious way to keep our minds sharp, the science behind intellectual engagement is truly more complex than simply a "use it or lose it" equation.

So why do I and other brain health experts spend so much time getting people to stretch their brains? Why does what we do with our minds matter so much? Here are some of the reasons why I'm a big fan of being intellectually passionate at every age:

  • A passionate mind leads to a healthy brain. One measure of brain fitness is the physiological health of our brain itself. Intellectual enrichment has been associated with enhanced neuroplasticity, or the brain's ability to make new connections and grow new neurons in both animal and human studies. For example, a German study found that adults who became proficient jugglers showed increased brain volume on imaging studies.
  • A passionate mind gives us a buffer against serious memory loss. We have known for a while that staying intellectually engaged is associated with a lower risk for dementia in later life. This finding has been replicated across a number of large, epidemiological studies both here and in Europe. Such evidence has given rise to the "cognitive reserve" theory, which states that the neuroplasticity supported by such activities build a buffer zone of neural connections and new neurons that delay the onset of dementia symptoms. Most recently, a study out of Rush University Medical Center offers further support to this theory, with reported findings showing that folks who report high levels of lifelong intellectual engagement who develop memory impairment do so later in life and have a sharper and shorter period of impairment.
  • A passionate mind gives us a chance to boost daily brain skills. "Stretch activities" often help us better maintain everyday intellectual skills that are challenged by the aging process. These skills, primarily our ability to keep focused, think quickly and think nimbly, are best addressed by specific exercises played against the clock. However, engaging intellectually across the board -- be it by taking a language class or even working -- gives us more chances to "work out" those skills than we would have otherwise. Volunteering at a local youth center, for example, not only engages your mind, but also forces you to pay closer attention, hold conversations with folks you might not otherwise encounter, and think nimbly to keep up, all of which keep those daily brain skills better trained.
  • A passionate mind keeps us purposed and relevant. One of the most overlooked aspects of growing older is that we are still actually growing. Intellectual passions allow us the ways and means by which we can continue to think about and expand on who we are. Such pursuits give us the chance to constantly question ourselves, to ask the "what if" question that keeps us engaged (not to mention engaging). It is through such intellectual passions that we can learn more about our purpose and determine the legacy we wish to leave behind. While these aspects of well-being may seem more spiritual in nature, there is much to suggest that they matter greatly to brain health, in that they impact our ability to think wisely and to continue to engage richly and meaningfully in the world.

It was Rene Descartes, the French philosopher, who centuries ago counseled us that "It is not enough to have a good mind. The main thing is to use it well." While our understanding of the science behind having a good mind may have advanced, the advice remains the same. Take up a new language, master a new computer game, enroll for that drawing class you've always meant to take. Whatever your latest passion, pursue and enjoy! Consider such passionate pursuits part of your "Total Brain Health" prescription for staying vital and independent -- they are good for your mind, good for your brain, and, perhaps best of all, good for your spirit.

The Obese Has a Worse Impact on Environment

Researchers at the London School of Hygiene and Tropical Medicine published a study showing that, because of food production and transportation factors, a population of heavier people contributes more harmful gases to the planet than a population of thin people. As a result, the mining machinery takes active measures to protect the environment by producing green cone crushers.
Given that it takes more energy to move heavier people, transportation of heavier people requires more fuel, which creates more greenhouse gas emissions, the authors write. ?The main message is staying thin. It?s good for you, and it?s good for the planet,? said Phil Edwards, senior lecturer at the London School of Hygiene and Tropical Medicine.
The study offers this novel approach to the global warming problem as U.S. lawmakers discuss the future of climate change legislation. This week, the the House Energy and CommerceCommittee is scheduled to begin on a comprehensive energy and climate bill. On Friday, the Environmental Protection Agency announced that six greenhouse gases pose potential health hazards, an announcement that could prompt the regulation of the gases. More than 1 billion adults worldwide are overweight, and about 300 million are obese, the study said. Generally, the body mass index, a measure of obesity, is increasing in most countries worldwide, from China to European countries to the United States.
BMI is going up because of the availability of food and motorized transportation, Edwards said. People are less active now than they were 30 years ago, and the prence of fast food has given people less healthy, more energy-dense options. Using statistical models, the authors compared the distribution of BMI in the United Kingdom in the 1970s?when 3.5 percent of the population was obese?with a prediction for the country?s BMI distribution in 2010, reflecting 40 percent obesity.
?In terms of environmental impact, the lean population has a much smaller carbon footprint,? Edwards said. The population with 40 percent obese people requires 19 percent more food energy for its total energy expenditure than the population with 3.5 percent obese people, the study showed. This 19 percent increase in food consumption translates into an increase of 270 million metric tons of greenhouse gas emissions, the study said.
?The findings make sense and highlight an important global co-benefit of losing weight, along with the significant personal health benefits,? said Patrick Kinney, associate professor at Columbia University?s Mailman School of Public Health, who was not involved in the study. In terms of obesity rate, the U.S. population is not far off from the overweight population model in this study. The country has 33.3 percent obese people, according to the Mayo Clinic. The study suggests that governments have a responsibility to encourage people to be more physically active, Edwards said. CARDIFF CITY boss Malky Mackay insists his great friend Brendan Rodgers will revel in the pressure at Liverpool.

Rodgers quit the top job at Swansea City recently to take up the reigns at Anfield following the departure of Kenny Daglish.

At the age of just 39, the Northern Irishman finds himself in one of the most high profile posts in British football.

But Mackay, who is himself preparing for his second season in charge in the Welsh capital, believes Rodgers is ready for the challenge and more than equipped to make a success of things on Merseyside.

Mackay has been good friends with Rodgers since they were at Watford together.

After finishing his playing days with the Hornets, Mackay found himself caretaker manager at Vicarage Road after Aidy Boothroyd departed.

In November 2008 Rodgers was appointed Watford boss and kept Mackay on as his number two.

When Rodgers departed for an ill-fated spell at Reading he recommended Mackay as his successor in the Hornets? hot-seat handing the Scot his big break in football management.

Last summer Mackay joined Rodgers in Wales, but the Bluebirds? boss admits he is thrilled to see his friend move onwards and upwards.

?I?m absolutely delighted for Brendan. I?ve spoken to him regularly over the last couple of weeks.? said 40-year-old Mackay.

?He showed what he could do in the Premier League last season and now a club of higher standing has come in for him whilst his stock is high.

?He did a fantastic job at Swansea, that?s been well documented and it?s a very smart move by Liverpool.

?People might say he is young, but when you look at his reputation, at what he?s done then it is a move he has more than earned.?

Rodgers faces the task now of living up to the expectations of Liverpool and its supporters.

Anfield-legend Daglish was shown the door after Liverpool finished eighth last campaign and Rodgers? Reds will at least be expected to be challenging for a Champions League place this time around.

But Mackay believes Rodgers is strong minded enough to cope with the expectations.

?There?s not many clubs where there is more pressure than Liverpool,? said Mackay.

?But if you have ambition, which most managers do, and you want to play and manage at highest level then it's something you revel in.

?Brendan is the type who knows exactly what he wants to do when he goes in. He is a very focussed person.

?I?ve worked for him and he has a really good work ethic about him. He knows the way he wants to work and way he wants players to play.

?He will go in at Liverpool with exactly same work ethic and he will structure the club the way he wants it, I?ve no doubts that he will walk in and affect Liverpool from the start. Brendan will certainly not be overawed in the slightest that much is for certain.?

NuSTAR mission status report: Observatory unfurls its unique mast

ScienceDaily (June 25, 2012) ? NASA's Nuclear Spectroscopic Telescope Array, or NuSTAR, has successfully deployed its lengthy mast, giving it the ability to see the highest energy X-rays in our universe. The mission is one step closer to beginning its hunt for black holes hiding in our Milky Way and other galaxies.

"It's a real pleasure to know that the mast, an accomplished feat of engineering, is now in its final position," said Yunjin Kim, the NuSTAR project manager at NASA's Jet Propulsion Laboratory, Pasadena, Calif. Kim was also the project manager for the Shuttle Radar Topography Mission, which flew a similar mast on the Space Shuttle Endeavour in 2000 and made topographic maps of Earth.

NuSTAR's mast is one of several innovations allowing the telescope to take crisp images of high-energy X-rays for the first time. It separates the telescope mirrors from the detectors, providing the distance needed to focus the X-rays. Built by ATK Aerospace Systems in Goleta, Calif., this is the first deployable mast ever used on a space telescope.

On June 21 at 10:43 a.m. PDT (1:43 p.m. EDT), nine days after launch, engineers at NuSTAR's mission control at UC Berkeley in California sent a signal to the spacecraft to start extending the 33-foot (10-meter) mast, a stable, rigid structure consisting of 56 cube-shaped units. Driven by a motor, the mast steadily inched out of a canister as each cube was assembled one by one. The process took about 26 minutes. Engineers and astronomers cheered seconds after they received word from the spacecraft that the mast was fully deployed and secure.

The NuSTAR team will now begin to verify the pointing and motion capabilities of the satellite, and fine-tune the alignment of the mast. In about five days, the team will instruct NuSTAR to take its "first light" pictures, which are used to calibrate the telescope.

Why did NuSTAR need such a long, arm-like structure? The answer has to do with the fact that X-rays behave differently than the visible light we see with our eyes. Sunlight easily reflects off surfaces, giving us the ability to see the world around us in color. X-rays, on the other hand, are not readily reflected: they either travel right through surfaces, as is the case with skin during medical X-rays, or they tend to be absorbed, by substances like your bone, for example. To focus X-rays onto the detectors at the back of a telescope, the light must hit mirrors at nearly parallel angles; if they were to hit head-on, they would be absorbed instead of reflected.

On NuSTAR, this is accomplished with two barrels of nested mirrors, each containing 133 shells, which reflect the X-rays to the back of the telescope. Because the reflecting angle is so shallow, the distance between the mirrors and the detectors is long. This is called the focal length, and it is maintained by NuSTAR's mast.

The fully extended mast is too large to launch in the lower-cost rockets required for relatively inexpensive Small Explorer class missions like NuSTAR. Instead NuSTAR launched on its Orbital Science Corporation's Pegasus rocket tucked inside a small canister. This rocket isn't as expensive as its bigger cousins because it launches from the air, with the help of a carrier plane, the L-1011 "Stargazer," also from Orbital.

NuSTAR is a Small Explorer mission led by the California Institute of Technology in Pasadena and managed by JPL for NASA's Science Mission Directorate in Washington. The spacecraft was built by Orbital Sciences Corporation, Dulles, Va. Its instrument was built by a consortium including Caltech; JPL; the University of California, Berkeley; Columbia University, New York; NASA's Goddard Space Flight Center, Greenbelt, Md.; the Danish Technical University in Denmark; Lawrence Livermore National Laboratory, Livermore, Calif.; and ATK Aerospace Systems, Goleta, Calif. NuSTAR will be operated by UC Berkeley, with the Italian Space Agency providing its equatorial ground station located at Malindi, Kenya. The mission's outreach program is based at Sonoma State University, Rohnert Park, Calif. NASA's Explorer Program is managed by Goddard. JPL is managed by Caltech for NASA.

Biofuels: Ethanol extraction from oil palm

Researchers first separated glucose from cellulose in the plant matter, and then used it as a substrate for ethanol production.

Oil palm empty fruit bunch is an abundant biomass waste, with 15 million tonnes generated annually by palm oil mills in Malaysia alone. Usually it is burnt in incinerators to obtain bunch ash or dumped for mulching in oil palm plantations.

Biofuels are an alternative energy source, and ethanol is the most commonly used around the world.

In this research, Suraini Abd-Aziz and colleagues in Malaysia and Japan set out to see if it is possible to use glucose recovered during phase separation process of acid-hydrolysed oil palm empty fruit for ethanol production. Once separated, they tested different nitrogen sources to find the most efficient for the fermentation of the glucose to ethanol, finding both yeast and palm oil mill effluent work well. The work presents a new approach to producing high yield ethanol using an abundant source of biomass.
